Nothing communicated in any session, on the Platform, or by its personnel should be construed as medical advice or a recommendation to alter any prescribed medication or treatment.') ?>
  • D1.3If you have, or suspect you may have, any of the following conditions, you must consult a qualified medical professional before participating: cardiovascular disease, hypertension, diabetes, pregnancy, spinal injuries, joint disorders, chronic pain conditions, eating disorders, clinical depression, anxiety disorders, epilepsy, or any recent surgical procedure.') ?>
  • D1.4You are responsible for disclosing all relevant health conditions in your wellness profile and directly to your teacher before commencing practice.   • D3.1Physical exercise, including yoga, carries an inherent risk of injury. You voluntarily assume all such risks by participating, including but not limited to muscle strain, joint injury, dizziness, or falls.') ?>
  • D3.2You confirm that you are physically and mentally fit to participate in yoga sessions and that participation does not conflict with any medical advice you have received.') ?>
  • D3.3You agree that you are solely responsible for ensuring your practice environment at home is safe, clear of obstructions, and suitable for physical exercise. The Foundation accepts no liability for injuries arising from conditions in your personal environment.') ?>
  • D3.4You are responsible for ensuring that your internet connection, device, and Zoom application are functioning adequately. Technical difficulties on your end that affect session access or attendance recording are not grounds for a refund or credit adjustment.') ?>
  • D3.5You are encouraged to listen to your body at all times, modify or skip poses that cause discomfort, and communicate openly with your teacher about any limitations. Your wellbeing is always more important than completing a pose.') ?>
Always follow your teacher\'s instructions. However, if any instruction causes you pain or discomfort, you have the right — and responsibility — to stop and modify. You know your body better than anyone else.') ?>

  • D4.1Wallet Credits are not money. They are a platform-specific incentive mechanism that can only be used within the Back to the Source Platform. They carry no monetary value, cannot be encashed, transferred, or redeemed outside the Platform.') ?>
  • D4.2The Platform does not operate as a bank, payment institution, or financial service of any kind. Wallet Credits do not constitute a deposit, investment, or financial instrument regulated by the Reserve Bank of India or any other authority.') ?>
  • D4.3The refund model — whereby attendance earns Wallet Credits — is an incentive programme, not a contractual obligation to return money. Credits earned are subject to the conditions, restrictions, and expiry terms set out in the Terms & Conditions. No legal claim for cash payment arises from the earning of Wallet Credits.') ?>
  • D4.4The Foundation does not guarantee that the refund model will remain unchanged indefinitely. The structure of credits, percentages, and expiry periods may be revised with appropriate notice, and no retrospective entitlement arises from prior earning of credits under an earlier model.') ?>
  • D4.5The Annual Membership Fee and Weekly Fees are service charges for access to Platform features and live sessions respectively. They are not deposits, prepayments, or savings instruments.') ?>
  • D4.6All financial transactions are processed by third-party payment gateways (e.g., Razorpay). The Foundation does not store card or banking details. The Foundation is not liable for any unauthorised transaction arising from a breach of security at the payment gateway level.') ?>
Under no circumstances will any cash, bank transfer, cheque, or monetary payment be made to a User as a "refund" from the Platform. Any entity or individual claiming otherwise on behalf of the Foundation is acting fraudulently. Report such incidents immediately to contact@aarshfoundation.com.') ?>

  • D5.1The Foundation endeavours to keep the Platform available at all times but does not guarantee uninterrupted, error-free, or secure access. Scheduled maintenance, technical failures, or circumstances beyond the Foundation\'s control may affect availability.') ?>
  • D5.2Sessions are conducted via Zoom, a third-party video conferencing platform. The Foundation is not responsible for: (a) Zoom outages or technical failures; (b) issues arising from Zoom\'s own terms of service; or (c) any privacy incident occurring within Zoom\'s infrastructure.') ?>
  • D5.3Where a Session is disrupted due to a platform-side technical failure (i.e., one that is confirmed to be within the Foundation\'s control), the Foundation shall, at its discretion, either reschedule the session or ensure that attendance is not counted as missed.') ?>
  • D5.4The Platform may undergo updates, enhancements, or modifications from time to time. The Foundation does not warrant that any particular feature will remain available in perpetuity.') ?>
  • D5.5Attendance is tracked automatically via Platform login. The Foundation shall not be liable for attendance not being recorded due to User error, such as joining via an incorrect account, browser incompatibility, or failure to follow the joining instructions provided.') ?>

  • D6.2The teacher is not a licensed medical professional. Any wellness guidance, dietary suggestion, or lifestyle recommendation offered during a session is general in nature and should not be followed in place of advice from a qualified doctor, dietitian, or health professional.') ?>
  • D6.3The Foundation shall not be liable for any loss, injury, or harm arising from a User following teacher guidance if the User has failed to disclose a relevant health condition or has followed instructions in a manner inconsistent with those given.') ?>
  • D6.4The content, sequencing, and style of sessions may vary from week to week. The Foundation does not warrant that any specific session format, pose sequence, or teaching approach will be maintained indefinitely.') ?>
  • D6.5In the event of the assigned teacher\'s absence, the Foundation will endeavour to provide a qualified substitute teacher or offer rescheduling. A change of teacher does not constitute grounds for a fee refund.') ?>

  • D7.1The Platform uses third-party services including Zoom (video conferencing), Razorpay or equivalent (payment processing), and email/messaging tools. The Foundation has no control over these third parties and is not liable for any failure, data breach, or conduct attributable to them.') ?>
  • D7.2Your use of Zoom is additionally governed by Zoom\'s own Terms of Service and Privacy Policy, which the Foundation encourages you to review. The Foundation is not a party to your agreement with Zoom.') ?>

  • D8.2You are granted a limited, personal, non-exclusive, non-transferable licence to access and use the Platform for your own wellness purposes only. This licence does not permit you to reproduce, distribute, publicly perform, or commercially exploit any part of the Platform\'s content.') ?>
  • D8.3Recording of sessions in any format is strictly prohibited without the express prior written consent of the Foundation. Unauthorised recording may constitute infringement of copyright and performers\' rights under the Copyright Act, 1957 (India).') ?>
  • D8.4The Platform\'s model, including the refund and wallet credit mechanism, represents original intellectual work of the Foundation. Any attempt to replicate, commercially appropriate, or publicly pass off this model as your own may give rise to legal action.') ?>

  • D9.1The Pay It Forward and Donation features are voluntary, philanthropic mechanisms operated by the Holistic Healing Foundation. They do not constitute a regulated charitable solicitation, investment scheme, or financial product.') ?>
  • D9.2The Foundation will administer all donated and pay-it-forward funds in good faith and in accordance with its wellness mandate. However, the Foundation does not issue tax receipts for such contributions during the pilot phase unless otherwise stated.') ?>
