Please read this Agreement carefully before registering. By creating an account or using the Platform in any manner, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Platform.

This Agreement is intended to be fair, transparent and protective of both parties. Our model is built on trust and mutual benefit — these terms exist to preserve that.
1.
Definitions
Interpretation

In this Agreement, the following expressions shall have the meanings assigned to them below, unless the context otherwise requires:

"Platform"
The Back to the Source website, mobile application, and all associated services operated by the Holistic Healing Foundation.
"Member" / "User"
Any individual who has registered an account on the Platform and holds a valid Annual Membership.
"Annual Membership"
The non-refundable annual access fee paid by the User to unlock weekly bookings and Platform features.
"Weekly Fee"
The fee paid by the User each week to participate in five (5) scheduled live sessions (Monday to Friday).
"Session"
A 40-minute live online yoga class conducted via Zoom, forming part of the weekly schedule.
"Wallet Credit"
A non-monetary, non-encashable credit issued to the User's in-app Wallet upon satisfying the attendance criteria for a given week.
"Attendance"
Active participation in a Session for a minimum of thirty (30) minutes, verified through platform login under the User's registered account.
"Refund"
The issuance of Wallet Credits to the User. No cash or monetary payment shall be made to Users under any refund entitlement.
"Credit Expiry"
The automatic forfeiture of Wallet Credits that have not been applied toward a future booking within fourteen (14) calendar days of issuance.
"Pay It Forward"
A voluntary feature allowing a User to apply Wallet Credits or make a direct payment to sponsor another person's access to the Platform.
"Misuse"
Any action, omission, or conduct by a User intended to circumvent the fair operation of the refund model, wallet system, or any other feature of the Platform.
"Foundation"
The Holistic Healing Foundation, the entity that owns and operates Back to the Source.
2.
Eligibility & Account Registration
User Rights
  1. 2.1The Platform is open to individuals who are sixteen (16) years of age or older. Persons aged 16 to 18 must obtain prior written consent from a parent or legal guardian, who shall be jointly responsible for compliance with this Agreement.
  2. 2.2Each individual may maintain one (1) account only. The Foundation reserves the right to verify identity where accounts appear to be duplicated. Multiple accounts held by the same individual shall all be subject to termination.
  3. 2.3You agree to provide accurate, complete and truthful information at registration, including your name, email address, mobile number, date of birth and any health information relevant to safe participation in yoga.
  4. 2.4Your account is personal and non-transferable. You shall not share your login credentials with any other person, nor permit another individual to access the Platform using your account.
  5. 2.5You are responsible for maintaining the confidentiality of your account password. You must notify the Foundation promptly if you suspect unauthorised access to your account.
  6. 2.6You have the right to update your registered information at any time through your Profile page. Outdated information that affects session safety is your responsibility to correct.
3.
Annual Membership & Weekly Fees
Fees & Payment
3.A — Annual Membership
  1. 3.1Access to the Platform requires payment of an Annual Membership Fee of per annum (or such revised amount as notified by the Foundation with not less than thirty (30) days' advance notice).
  2. 3.2The Annual Membership Fee is strictly non-refundable upon payment, irrespective of the reason for cancellation or termination — save only in the event that the Foundation permanently discontinues the Platform, in which case a pro-rated refund shall be issued.
  3. 3.3Membership grants you the right to: (a) book and attend weekly Sessions; (b) access free weekend classes when available; (c) operate your in-app Wallet; and (d) access all community features including Pay It Forward and Donate.
  4. 3.4Membership renews automatically on an annual basis. The Foundation shall provide written notice of renewal at least thirty (30) days prior to the renewal date. You may cancel renewal at any time before the renewal date.
3.B — Weekly Session Fee
  1. 3.5The Weekly Fee is per week (or such revised amount as notified in accordance with Clause 3.7), payable in advance, and entitles you to book and attend five (5) Sessions in a given week (Monday to Friday).
  2. 3.6The Weekly Fee must be paid before the commencement of the relevant week. Sessions in an unpaid week will not count toward any Wallet Credit entitlement.
  3. 3.7Any revision to the Weekly Fee shall be communicated to all active Members with a minimum of thirty (30) days' written notice. Revised fees shall not apply retrospectively to weeks already paid for.
  4. 3.8Wallet Credits from previous weeks may be applied toward the Weekly Fee. Where the balance is insufficient, the User must top up the shortfall before the booking is confirmed.
  5. 3.9Payment disputes initiated with a bank or card provider (chargebacks) without first raising the matter with the Foundation shall result in immediate account suspension pending investigation. Fraudulent chargebacks may result in permanent termination and recovery proceedings.
4.
Attendance & Wallet Credit Entitlement
Core Benefit

This Clause sets out the conditions under which Wallet Credits are earned. These provisions are fundamental to the Platform's model and must be strictly observed by all Users.

4.B — Attendance Verification
  1. 4.1Attendance is verified automatically when you join a Session via Zoom using the link associated with your registered account. You must be present for a minimum of thirty (30) minutes of a forty (40)-minute Session for it to be recorded as attended.
  2. 4.2If a Session is cancelled by the Foundation due to insufficient enrolment (fewer than five (5) students), that Session shall not be counted as a missed class and shall not prejudice your Wallet Credit entitlement for that week. You will be notified at least two (2) hours in advance.
  3. 4.3In the event of a genuine medical emergency, bereavement, or other compelling circumstance, you may apply in writing to the Foundation within forty-eight (48) hours of the missed Session, supported by reasonable documentation. The Foundation shall review such applications on a case-by-case basis and at its absolute discretion.
  4. 4.4Joining a Session and disconnecting within the first five (5) minutes, or joining without active participation for the purpose of recording attendance only, shall not constitute valid Attendance and shall be treated as Misuse under Clause 7.
Important: All Wallet Credits are issued exclusively in the form of in-app credits. Under no circumstances shall a Wallet Credit constitute a debt, monetary entitlement, or legal claim against the Foundation. No cash payment shall be made to any User on account of Wallet Credits.
5.
Wallet Credits — Use, Expiry & Restrictions
Wallet Rules
  1. 5.1Wallet Credits may be applied toward: (a) payment of future Weekly Fees; (b) Pay It Forward contributions; or (c) Donations to the Foundation's community fund.
  2. 5.2Wallet Credits have no monetary value outside the Platform and shall not be: (a) redeemed for cash; (b) transferred between accounts; (c) sold, gifted or assigned to any third party; (d) used as consideration in any transaction outside the Platform; or (e) converted into any currency, voucher or other instrument of value.
  3. 5.3Wallet Credits shall automatically expire fourteen (14) calendar days from the date of issuance if not applied toward a booking within that period. Expired Credits are permanently forfeited and shall not be reinstated under any circumstances.
  4. 5.4The Foundation shall issue an in-app reminder notification three (3) days prior to expiry. Responsibility for timely use of Credits rests solely with the User.
  5. 5.5Upon voluntary closure or involuntary termination of an account for any reason, all Wallet Credits are permanently forfeited and may not be transferred, encashed, or recovered.
  6. 5.6Any attempt to exploit, manipulate or circumvent the Wallet system — including but not limited to fabricating attendance, exploiting technical errors to inflate credits, or creating duplicate bookings — constitutes Misuse and shall be actionable under Clause 7.
Note on Credit Expiry: The 14-day expiry window is a structural element of the Platform's financial model, enabling the Foundation to maintain low fees, fund community access, and sustain operations. It is not a punitive measure. Users are encouraged to plan bookings accordingly.
6.
Session Booking, Cancellation & Conduct
Your Sessions
6.A — Booking
  1. 6.1You may book any five (5) Sessions from the weekly schedule. Sessions are available for booking up to three (3) months in advance on a first-come, first-served basis, subject to a maximum of ten (10) Users per Session.
  2. 6.2Slot blocking is prohibited. Booking Sessions with no genuine intention to attend — whether to reserve capacity or restrict access to others — constitutes Misuse. Repeat non-attendance without cancellation may result in booking restrictions being applied to your account.
6.B — Cancellation by User
  1. 6.3You may cancel a booked Session at no penalty if done at least two (2) hours before the scheduled start time. Such cancellation shall not be recorded as a missed Session.
  2. 6.4Cancellations made within two (2) hours of the scheduled start, or failure to attend without cancellation, shall be recorded as a missed Session and shall count toward the Wallet Credit entitlement calculation for that week.
6.C — Conduct in Sessions
  1. 6.5You agree to participate in Sessions respectfully and in a manner that does not disrupt the experience of other participants or the teacher. Disruptive, offensive, or inappropriate conduct shall result in immediate removal from the Session and review of your account.
  2. 6.6Recording Sessions — in whole or in part, by any means — without the prior written consent of the Foundation is strictly prohibited and may constitute an infringement of intellectual property rights.
  3. 6.7You are encouraged to keep your camera on during Sessions to enable the teacher to provide safe and personalised guidance. Where this is not possible, prior notice to the teacher is requested.
  4. 6.8The Foundation and its teachers shall not be liable for any physical injury sustained during a Session if: (a) you failed to disclose a relevant health condition; (b) you did not follow the teacher's instructions; or (c) your injury arose from conditions entirely outside the teacher's knowledge or control.
7.
Fair Use Policy & Prohibited Conduct
Critical Clause

The Platform's model is designed in good faith to benefit genuine users. The following acts constitute Misuse and shall render the User liable to account suspension, permanent termination and — where applicable — civil or criminal proceedings.

7.A — Prohibited Acts
  1. 7.1Multiple Accounts: Registering or operating more than one account — whether in the User's own name or that of another person — for the purpose of earning additional Wallet Credits or circumventing any usage limit.
  2. 7.2Proxy Attendance: Permitting or arranging for any other person to attend a Session using your account credentials, or attending on behalf of another user whose Session booking you have made in your name.
  3. 7.3False Attendance: Joining a Session without genuine participation for the purpose of triggering the attendance verification mechanism, including any technical manipulation of the Zoom or Platform system.
  4. 7.4Exploitation of Goodwill Provisions: Repeatedly claiming exceptional circumstances under Clause 4.3 without legitimate documentation or genuine cause, with the intent to preserve Wallet Credits that would otherwise be forfeited.
  5. 7.5Wallet Credit Manipulation: Any act intended to artificially inflate Wallet Credits, including but not limited to exploiting known technical errors and failing to report them to the Foundation.
  6. 7.6Commercial Exploitation: Using the Platform, its Sessions, or its content for any commercial purpose — including streaming, sub-licensing, or charging others for access — without the Foundation's express written consent.
  7. 7.7Technical Interference: Using automated scripts, bots, crawlers, VPNs to misrepresent identity, or any other technical means to interact with the Platform in a manner not intended for genuine Users.
  8. 7.8Slot Blocking: As described in Clause 6.2 — reserving Sessions with no intention of attending.
Disclosure Obligation: If you discover a technical error that results in Wallet Credits or other financial benefit to you beyond your entitlement, you are under an obligation to report it to the Foundation at contact@aarshfoundation.com within forty-eight (48) hours. Failure to do so, or deliberate exploitation of such an error, shall constitute Misuse.
7.B — Monitoring & Investigation
  1. 7.9The Foundation reserves the right to monitor attendance patterns, booking behaviour, wallet activity and account usage for the purpose of detecting Misuse. Unusual patterns shall trigger a review.
  2. 7.10Before taking any action, the Foundation shall ordinarily notify the User of the concern and provide an opportunity to respond within seventy-two (72) hours, except where immediate suspension is necessary to prevent ongoing harm to the Platform or other Users.
8.
Pay It Forward & Donations
Community
  1. 8.1Pay It Forward contributions and Donations are entirely voluntary and shall be applied at the User's direction toward sponsoring another person's Platform access or to the Foundation's general wellness fund.
  2. 8.2All Pay It Forward contributions and Donations are irrevocable once committed. No refund or credit reversal shall be made in respect of such contributions, including upon account closure or termination.
  3. 8.3The Foundation shall administer all donated and pay-it-forward funds in accordance with the Holistic Healing Foundation's mandate. Sponsored access shall be extended to verified recipients only.
  4. 8.4A User may not use the Pay It Forward feature to sponsor their own access under a secondary account, or to transfer value to themselves by any indirect means. Such conduct constitutes Misuse under Clause 7.
  5. 8.5Gift memberships sent to third parties are non-refundable once the recipient has activated their account. Prior to activation, cancellation requests may be considered at the Foundation's discretion.
9.
Suspension, Termination & Consequences
Enforcement
9.A — Termination by User
  1. 9.1You may close your account at any time by written notice to the Foundation. Upon closure: (a) all Wallet Credits shall be permanently forfeited; (b) the Annual Membership Fee shall not be refunded; and (c) any pending Sessions in an already-paid week shall remain accessible until the end of that week.
9.B — Action by Foundation
  1. 9.2First Violation: A written warning shall be issued. The account may be temporarily restricted for a period not exceeding seven (7) days pending the User's response. No Wallet Credits shall accrue during a period of restriction.
  2. 9.3Serious or Repeat Violation: The Foundation may suspend the account with immediate effect. All accrued Wallet Credits shall be forfeited. The Annual Membership Fee shall not be refunded.
  3. 9.4Fraud or Deliberate Misuse: Permanent termination without notice. The Foundation reserves the right to initiate civil proceedings for recovery of any financial loss caused by the User's conduct, and to report criminal conduct to the appropriate authorities.
  4. 9.5Right of Appeal: A User whose account has been suspended or terminated may submit a written appeal to the Foundation within fourteen (14) days of the decision. The Foundation shall respond within seven (7) working days. The Foundation's decision on appeal shall be final.
10.
Privacy & Data Protection
Your Rights
  1. 10.1The Foundation collects and processes personal data for the following purposes only: (a) account administration and identity verification; (b) session booking and Wallet management; (c) payment processing; (d) personalising your wellness experience; and (e) communication regarding classes, policy changes and account matters.
  2. 10.2Your health and wellness profile information is shared solely with your assigned teacher and only to the extent necessary for your safety and the personalisation of your sessions. It shall not be used for any commercial, marketing, or third-party purpose.
  3. 10.3The Foundation shall not sell, rent, transfer, or otherwise disclose your personal data to any third party for commercial purposes. Data may be shared with service providers (e.g., payment processors, communication tools) solely for operational purposes, under confidentiality obligations.
  4. 10.4You have the right to: (a) access the personal data held about you; (b) request correction of inaccurate data; (c) request deletion of your data upon account closure; and (d) withdraw consent to specific processing activities where applicable under law.
  5. 10.5Data requests should be directed to contact@aarshfoundation.com. The Foundation shall respond within fifteen (15) working days.
11.
Limitation of Liability & Disclaimers
Legal Protection
  1. 11.1The Sessions offered on the Platform are wellness-oriented and are not a substitute for professional medical advice, diagnosis or treatment. If you have a medical condition, you should consult a qualified healthcare professional before commencing any yoga practice.
  2. 11.2The Foundation's total liability to you in connection with this Agreement — whether in contract, tort, or otherwise — shall not exceed the total amount paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.
  3. 11.3The Foundation shall not be liable for: (a) technical disruptions to Zoom or third-party services beyond its control; (b) loss of data arising from circumstances outside its control; (c) indirect or consequential losses of any kind.
  4. 11.4Nothing in this Clause shall operate to limit the Foundation's liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded by law.
12.
General Provisions
Governing Terms
  1. 12.1Amendments: The Foundation reserves the right to amend these Terms at any time. Material amendments shall be communicated to all Users at least fourteen (14) days in advance via email and in-app notification. Continued use of the Platform after the effective date of any amendment constitutes acceptance.
  2. 12.2Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Republic of India.
  3. 12.3Jurisdiction: Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [City], India.
  4. 12.4Dispute Resolution: Prior to initiating any legal proceedings, both parties agree to attempt resolution through good-faith direct communication for a period of thirty (30) days. Disputes should first be raised at contact@aarshfoundation.com.
  5. 12.5Severability: If any provision of this Agreement is found to be unlawful, void, or unenforceable, that provision shall be deemed severed. The remaining provisions shall continue in full force and effect.
  6. 12.6Entire Agreement: This Agreement, together with the Privacy Policy, constitutes the entire agreement between the parties and supersedes all prior representations, arrangements or understandings.
  7. 12.7Waiver: Failure by the Foundation to enforce any provision of this Agreement on any occasion shall not constitute a waiver of its right to enforce that provision on any subsequent occasion.

By registering and using the Platform, you confirm your acceptance of this Agreement. Your name and registration date will be recorded as your electronic acceptance.
